General Terms and Conditions

These General Terms and Conditions apply to the use of the website onlycars.de, the OnlyCars dealer web app, and public share pages, as well as the purchase and use of video packages and enabled additional digital features provided by OnlyCars GmbH. OnlyCars is intended for businesses, particularly car dealerships, vehicle dealers, and commercial vehicle marketers. Consumers within the meaning of Section 13 of the German Civil Code (BGB) may also use OnlyCars where access or purchases are offered to them. Consumers additionally benefit from statutory consumer protection rights, particularly the right of withdrawal in accordance with these Terms and Conditions and applicable statutory provisions.

OnlyCars provides a web app that allows users to upload vehicle data and images, create vehicle projects, and have vehicle videos generated automatically from them. Depending on the feature, completed videos can be downloaded and published via public share pages. Share pages may contain vehicle data, dealer data, CTA links, performance analytics, and lead forms. OnlyCars does not owe any specific sales results, number of leads, or reach. The service consists of the technical provision of the web app and the described video and sharing features within the scope of the features available at the time.

A user account is required to use the dealer web app. Users must provide complete and accurate information when registering and using the service and must keep their login credentials confidential. The user is responsible for all actions taken through their account to the extent that those actions are attributable to them. OnlyCars must be informed immediately of any suspected misuse or unauthorized access.

The first successfully rendered vehicle video may be free for each dealer account. The free video is only considered used once rendering has completed successfully. Failed renderings do not use up the free video. OnlyCars may implement technical safeguards against multiple registrations, circumvention, or misuse.

After the free video, users can purchase video packages as a one-time purchase. The currently planned video packages are: - Listing: 2 videos for 9.90 EUR. - Business: 10 videos for 44.90 EUR. - Professional: 30 videos for 109.90 EUR. Unless otherwise stated, prices include statutory VAT for consumers, or are exclusive or inclusive of VAT as shown at checkout and on the invoice. The price displayed in Stripe Checkout at the time of purchase is decisive.

OnlyCars may additionally enable studio backgrounds for users as a pilot feature. This feature is used to create vehicle images with AI background removal and an OnlyCars studio background. A publicly available pricing model for studio backgrounds has not yet been established. If studio credits are offered for purchase in the future, the price displayed at checkout at the time of purchase will be decisive.

Purchased video packages are added to the user account as video credits and entitle the user to create the corresponding number of successful vehicle videos. Where studio credits are enabled as part of a pilot or later made available for purchase, they entitle the user to create the corresponding number of successful studio images. Purchased credits expire 12 months after their respective purchase date if they have not been used by then. Cash payouts, transfers to other user accounts, or conversion to other services are excluded to the extent permitted by law. Studio credits enabled as part of a pilot may be subject to different test conditions, provided these are communicated when the credits are enabled.

As a rule, one video credit is used when a vehicle video has been successfully created. One studio credit is generally used when a studio image has been successfully created. No credits are permanently used up if rendering or studio image creation fails. Credits may be temporarily reserved while a render job or studio image creation is in progress to prevent more jobs from being started than the available credits allow. If the job is not completed successfully, the reservation is released or no credits are permanently used up.

Payments are processed through Stripe. The user is redirected to Stripe Checkout to make a payment. Invoices, payment status, and payment information are processed through Stripe and, where available, can be managed through the Stripe customer portal. OnlyCars does not store complete credit card or bank account details. Stripe's terms and privacy notices additionally apply to payment processing.

Consumers generally have a statutory right of withdrawal of 14 days for distance contracts. Details are set out in the withdrawal instructions provided to the consumer during the order process or, at the latest, with the contract confirmation. For digital content or digital services, the right of withdrawal may expire under the applicable statutory provisions if OnlyCars has begun performing the contract, the consumer has expressly consented to performance beginning before the withdrawal period expires, the consumer has acknowledged that the right of withdrawal will expire, and the legally required confirmation has been provided. The withdrawal instructions are available at https://www.onlycars.de/widerruf. Until these requirements are met, statutory consumer rights remain unaffected.

Once a vehicle video or studio image has been successfully created and the corresponding credits have therefore been used, there is no entitlement to a refund of the credits used for it, unless statutory rights, particularly consumer rights or warranty rights, provide otherwise.

The user agrees not to misuse OnlyCars or upload or publish content that is unlawful or infringes the rights of third parties. This includes, in particular, copyrights, trademark rights, personality rights, data protection rights, and requirements under competition law. The user must ensure that they are entitled to use all uploaded images, text, logos, vehicle data, and links. The user is also responsible for ensuring that vehicle information, prices, descriptions, contact information, and CTA links are accurate, current, and legally permissible.

The user grants OnlyCars the rights necessary to provide the agreed services. This includes, in particular, the right to technically store and process uploaded images, text, logos, and vehicle data, incorporate them into videos, provide share pages, and enable downloads. After successful creation, the user may use the completed videos for their own vehicle marketing, particularly for listings, websites, social media, messaging services, sales materials, and online ads. OnlyCars may not freely use uploaded content for its own advertising or other purposes unless separate consent or an agreement exists.

Public share pages may be publicly accessible and viewed by third parties. The user decides which vehicle and dealer data are published or stored in their profile. When prospective customers send an inquiry through a share page, it is displayed in the dealer account. OnlyCars does not guarantee that leads will result in sales, viewings, test drives, or other transactions.

OnlyCars may provide links to external platforms such as Instagram, TikTok, YouTube, Facebook, WhatsApp, app stores, or other third-party offerings. Opening these links takes the user away from OnlyCars. The respective providers are responsible for the content, availability, terms, and data processing of external platforms.

OnlyCars strives to operate the web app reliably and securely. Uninterrupted availability at all times is not guaranteed. Maintenance, security measures, updates, service provider disruptions, or force majeure may result in limitations. OnlyCars may further develop, change, or replace features, provided this does not materially impair the principal service owed under the contract.

OnlyCars may temporarily suspend or permanently remove user accounts or individual content if there are specific indications of misuse, fraud, unlawful content, a lack of rights to images or text, attacks on systems, circumvention of technical safeguards, payment fraud, or other significant violations of these Terms and Conditions. The right to terminate for good cause without notice remains unaffected.

Statutory warranty rights apply. Businesses are additionally subject to statutory duties of inspection and notification of defects where applicable. Matters of taste, anticipated sales results, or subjective expectations regarding style, reach, or the number of leads do not constitute a defect if the agreed technical service has been properly provided.

OnlyCars is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory provisions. In the event of a slightly negligent breach of essential contractual obligations, OnlyCars is liable only for foreseeable damage typical of the contract. Essential contractual obligations are obligations whose fulfillment makes proper performance of the contract possible in the first place and on whose compliance the user may regularly rely. In all other respects, liability is excluded to the extent permitted by law. In particular, OnlyCars is not liable for a lack of sales or leads, incorrect or incomplete information provided by the user, content unlawfully uploaded by the user, or disruptions beyond OnlyCars' control.

The user shall indemnify OnlyCars against third-party claims arising from unlawful use of the platform, content provided by the user, or the user's breach of these Terms and Conditions. This also includes reasonable costs of legal defense to the extent that the user is responsible for the infringement.

OnlyCars may amend these Terms and Conditions where there is an objective reason and the change is reasonable for users. Users will be informed of significant changes in an appropriate manner. Individual purchases are generally subject to the version of the Terms and Conditions in effect at the time of purchase.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not restrict mandatory consumer protection provisions of the country in which the consumer habitually resides. The place of jurisdiction for merchants, legal entities under public law, and special funds under public law is Berlin.

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the applicable statutory provisions.

Where enabled, users can connect their YouTube channel to OnlyCars and expressly request the upload of selected vehicle videos. This feature uses YouTube API Services. By using the YouTube integration, users also agree to the YouTube Terms of Service and can find information on data processing and revoking access in our privacy policy.

Before uploading, users specify the video, title, description, and desired visibility. The integration is intended for vehicle videos and sends the designation “not made for kids.” This upload feature is not suitable for content specifically directed at children. Permissions, quotas, and platform reviews by Google/YouTube may restrict uploads or public visibility. A successful transfer therefore does not guarantee public publication. Videos already transferred can be managed directly in YouTube Studio; disconnecting does not delete them.
